Terms of Service

These Terms of Service (“Terms”) govern your use of capsule.nodemedia.in and the Capsule app-building service (“Service”), operated by Node Media (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Capsule converts a website you provide into a downloadable, branded Android application. You submit a URL and branding assets (icon, splash screen, app name, colors), and we generate an Android build (APK/AAB) for a one-time fee per app. The Service does not include a recurring subscription unless explicitly stated at checkout.

2. Eligibility and accounts

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. Your content and ownership

• You represent that you own, or have the necessary rights and permissions to use, the website, branding assets, and any other content you submit for app generation.
• You are solely responsible for the content, functionality, and legality of the website being wrapped into an app.
• You retain ownership of your website content and branding. Once delivered, you own the generated app build and may distribute it as you see fit, subject to the app store policies of any platform you publish to.

4. Acceptable use

You agree not to use the Service to generate an app for a website that:

• Is illegal, fraudulent, or infringes on the rights of others.
• Contains malware, phishing content, or attempts to harm users or devices.
• Violates the intellectual property, privacy, or publicity rights of any third party.
• Is intended to impersonate another person, brand, or organization without authorization.

We reserve the right to refuse, suspend, or terminate service to anyone who violates this section.

5. Payment and pricing

Fees are charged one-time, per app, at the price displayed at checkout. All fees are exclusive of applicable taxes unless stated otherwise. Refunds are handled under our Cancellation and Refund Policy.

6. Build delivery

Builds are generated through automated infrastructure (GitHub Actions) and made available for download from your dashboard once complete. Build times may vary. If a build fails due to an issue on our end and cannot be resolved, you are entitled to a refund as described in our Cancellation and Refund Policy.

7. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee that any app generated through the Service will be accepted by any particular app store, or that it will be free of defects arising from the underlying website.

8. Limitation of liability

To the maximum extent permitted by law, Node Media will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim arising from the Service is limited to the amount you paid for the app build giving rise to the claim.

9. Termination

We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability) will continue to apply.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless otherwise required by the mandatory law of your jurisdiction.
